Terms & Conditions             

INTRODUCTION 

(1)    The ESA Champions Awards (hereinafter “the Awards”) is an initiative organised by the European Space Agency (hereinafter “ESA” or the “Agency”) which aims at encouraging advocacy and raising awareness about Space in Europe in a creative manner and at building a community of space enthusiasts, by encouraging individual participants (hereinafter the “Participants”) to share creative and original contributions (hereinafter the “Contribution(s)”) focusing on ESA or on Space in Europe. 

(2)    The Winners of the Awards will receive Prizes and, in particular, will be declared as “ESA Champions”, in accordance with the following Terms and Conditions and as further described in Article 5 below. 

1.       SCOPE 

(1)    This document is issued by the European Space Agency, an international intergovernmental organisation established by its Convention, opened for signature in Paris on 30 May 1975 and entered into force on 30 October 1980, having its headquarters at 24 Rue du Général Bertrand, 75007 Paris, France, represented by its Director General, Josef Aschbacher, to set forth the terms and conditions for participation in the Awards.

(2)    Individuals willing to participate in the Awards are requested to carefully read these Terms and Conditions and make sure to act in compliance with them. 

(3)    By participating in the Awards, Participants hereby accept that their selection and participation shall be subject to, and governed by, these Terms and Conditions, which shall be legally binding for the Participants. 

 2.       PLANNING 

(1)    The Awards will run until 31 January 2023 inclusive.

(2)    The Winners will be announced in spring 2023. 

 3.       HOW TO PARTICIPATE 

3.1. Participation conditions 

(1)    The Awards are open to individuals residing in an ESA Member State, including Canada (as Cooperating State), Slovenia, Slovakia, Latvia and Lithuania (as Associate Member States), who are at least eighteen (18) years old when sharing their Contribution(s). 

(2)    Participants must act, at all times, in a manner that is not detrimental to ESA’s reputation and status as an international intergovernmental organisation. 

By sharing its Contribution(s), the Participant warrants to have the rights and authority to participate in the Awards and to comply with these Terms and Conditions. The Agency may require the Participants to provide proof of their eligibility. 

3.2 Participation process 

(1)    Modality to participate. To participate in the Awards, the Participant must share an original Contribution focusing on ESA and/or on Space in Europe via the dedicated online form provided by ESA on the Awards webpage. The Participant can also provide links to their website/YouTube channel/social media account where relevant Contributions can be found.

There is no limit to the number of Contributions that one Participant can share. However, the Participants will not be eligible for more than one prize. Contributions shared by Participants on behalf of other parties will not be taken into account. 

(2)    Contribution’s categories. To be eligible, the Contribution must fall within the following five (5) categories

1. Video: A YouTube series, movie, short film, etc.

2. Artwork: A painting, music piece, drawing, sculpture, collage, photography (also from digital sources), etc.

3. Storytelling: A written story, dialogue, poem, etc.

4. Public speaking: A show, conference, festival appearance, etc. 

5. Education: A lesson, activity or game for your students, etc. 

(3)     Contributions must be shared via the dedicated online form provided by ESA on the Awards webpage to be eligible for evaluation. To promote the initiative you can show what you have done via one of the following Social Media channels: Twitter, Facebook, Instagram, YouTube, LinkedIn, TikTok or Pinterest, using the hashtag #ESAchampion.

 (4)    General requirement for the Contribution(s).

  1. The Contribution must be original. In particular, it must not infringe any third party’s intellectual property rights, including trademarks.
  2. The Contribution must be communicated in any of the languages of ESA Member States, including of Canada (as Cooperating State), Slovenia, Slovakia, Latvia and Lithuania (as Associate Member States). 

(5)    Closing date for participation. To participate, Contributions must be shared no later than 31 January 2023 [23:59 CEST]. Contributions shared after this date will not be taken into consideration by ESA. 

 4.       WINNER SELECTION 

4.1 Selection criteria

The following criteria will be taken into account to evaluate the Contribution(s): 

-          ESA and Space for Europe Relevance. The Contribution must mention/have a focus on ESA and/or Space in Europe.

-          Originality. The Contribution must be unique and show creativity.

-          Skill/Craftsmanship. The Contribution should display a strong example of certain skill/talent. 

4.2   Judging panel and selection of the Winners 

(1)    The Agency will appoint a judging panel consisting of ESA experts (hereinafter the “Judges”). 

(2)    The Judges will select the winning Contribution(s) (hereinafter the “Winner’s Contribution”), and the winning Participants (hereinafter the “Winners”), from all Contributions considered by ESA. 

(3)    The Winner’s Contribution will be selected on the basis of the Selection criteria indicated in Article 4.1 above. The Judges’ decision will be binding and final for the Participants. 

(4)    The decision will be published in spring 2023

4.3   Announcement of the Winners 

(1)    The Agency will contact the Winners personally as soon as practicable, through the email address provided in the dedicated online form provided by ESA on the Awards webpage. 

(2)    All communication with the Agency will be done in English. 

(3)    The Winners and their Contributions may be published by the Agency on the ESA Website, the ESA Champions webpage and on other Social Media channels. The Winners hereby accept that, after the formal announcement, their names and respective Contributions may be disclosed to the public and published on the said channels. 

 5.       PRIZES 

(1) All winners of the ESA Champions Awards will receive an engraved, personalised plaque with name and winning Contribution signed by the ESA Director General Josef Aschbacher.

(2) In addition, three (3) prizes (hereinafter the “Prizes”) will be awarded to the Winners for each category (for a total of fifteen (15) prizes), as follows: 

 1st Prize: One-day visit to ESTEC, ESA’s technical heart in The Netherlands

 2nd Prize: Space-flown mission patch with framed certificate of authenticity

 3rd Prize: Merchandise bundle from the ESA Space Shop. 

(3)    The Winners will be declared “ESA Champions” and will be allowed to use this denomination on their social media channels or on other public channels. The denomination “ESA Champion” does not entitle the Winners to represent ESA or to act or talk on ESA’s behalf. In particular, the Winners hereby undertake not to claim being an ESA staff or spokesperson as a result of them being recognised as ESA Champions. The Agency and the Participant are independent parties and nothing herein is intended nor shall be construed as creating a partnership, joint venture, agency relationship or any exclusive arrangement between the Agency and the Participants and/or the Winners. 

(4)    No funds or monetary prizes whatsoever will be granted to the Participants as a consequence of their participation in the Awards, or to Winners. The Prizes are non-negotiable. 

(5)    No Prize can be claimed by a third party on a Winner’s behalf. 

(6)    The Agency may request further information before delivering the Prizes to the Winners, including, but not limited to, their name, email, and postal address. 

(7)    The Agency reserves the right to change the Prizes at its sole discretion.

 7.       OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS 

(1)    The Participants hereby grant to the Agency a non-exclusive, royalty-free worldwide license for the use, reproduction, transformation, sharing and streaming of the Participant’s Content, for the duration of the copyright term. 

(2)    ESA retains all rights and title over its Intellectual Property Rights. No license for the Participants and/or the Winners to use any ESA rights and interests is granted or implied by these Terms and Conditions. 

 8.       WARRANTIES AND LIABILITY 

(1)    The Agency will not be responsible for Contributions that are lost, mislaid or delayed in transit, regardless of the cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind even if occurring on the side of ESA. 

(2)    The Agency will make all reasonable efforts to contact the Winners but does not accept any responsibility should the Winners not respond or be unable to claim the Prize. 

(3)    Nothing herein may be interpreted as limiting the liability of the Participants or the Winners for gross negligence or wilful misconduct in the context of the Awards. 

(4)    In no case shall ESA be held liable for any failure, total or partial, with regard to its role in relation to the Awards, nor for any delays or errors in fulfilling its role. In particular, ESA shall not be liable for not selecting, or failing to select, a Participant as a Winner of the Awards.

(5)    Prior to sharing their Contribution(s), it is the Participants’ responsibility to obtain any intellectual property rights also from any third party to the extent it is necessary for the purpose to assign a license to ESA in accordance with Article 7.1 above. As such, Participants hereby guarantee that they hold all transferable rights on their Contribution and that such Contribution does not infringe any third parties’ rights. 

(6)    Should the Participant’s Contribution infringe any third party’s rights, he/she shall indemnify, and hold ESA harmless, from and against any and all claims, proceedings, direct and indirect damages, costs and expenses arising from the infringement of such third parties’ rights. 

(7)    ESA does not grant to the Participants any warranties whatsoever in connection with their participation in the Awards. 

 9.       EXCLUSION AND WITHDRAWAL 

(1)    ESA reserves the right to exclude a Contribution or a Participant from the Awards, at any time, if the Participant’s conduct or the Contribution is contrary to these Terms and Conditions or to the values, interest and reputation of the Agency or of its Member States. 

(2)    Should a Winner withdraw, for any reason whatsoever, from the Awards, the concerned Winner shall promptly and in writing notify ESA to that effect. 

(3)    Upon the exclusion or withdrawal of a Winner in accordance with the terms above, ESA may, at its discretion, select a new Winner. 

(4)    A decision to exclude and/or to select a replacement for the Winner of the Awards shall be taken by ESA at its sole and absolute discretion and shall be final and binding to the Participants in all respects. 

 10.   PERSONAL DATA PROTECTION AND PUBLICITY 

(1)    Protection of Personal Data is of great importance for ESA, which strives to ensure a high level of protection as required by the ESA Framework on Personal Data Protection (hereinafter the “ESA PDP Framework”, available at: http://www.esa.int/About_Us/Law_at_ESA/Highlights_of_ESA_rules_and_regulations) which applies to these Terms and Conditions.

(2)    ESA implements appropriate measures to preserve the rights of data subjects, to ensure the processing of personal data for specified and legitimate purposes, in a non-excessive manner, as necessary for the purposes for which the personal data are collected or for which they are further processed, in conditions protecting confidentiality, integrity and safety of personal data and in accordance with the principles set forth in the ESA PDP Framework. 

(3)    The ESA PDP Framework, in its implementation, aims at ensuring an equivalent level of protection as the European Union (EU) General Data Protection Regulation (Regulation (EU) 2016/679) in processing personal data. ESA processes your personal data for the purposes of this Awards in accordance with the principles of the ESA PDP Framework and as detailed in the ESA Champions Award Privacy Notice. ESA requires contracting companies that perform processing of personal data on behalf of ESA to ensure an adequate level of protection under the ESA PDP Framework (e.g. through compliance with EU Regulations in the field of personal data protection). 

(4)    The collection, handling and use of Personal Data relating to the Candidate shall be treated as proprietary personal information and appropriately protected at all times. However, the name, image, country of residence and Post of the Winners may be used by the Agency to announce the Winners of the Awards and for any other reasonable and related communication purposes. 

(5)    By sharing Contribution in accordance with these Terms and Conditions, Participants agree to the processing of its personal data as set forth herein. 

 11.   APPLICABLE LAW AND DISPUTES 

(1)    Except for personal data matters or incidents for which the ESA PDP Framework shall apply, and without prejudice to the applicability of the ESA Convention, and in particular of its Annex I on privileges and immunities, these Terms and Conditions shall be governed and shall be interpreted in accordance with the laws of France. 

(2)    ESA and the Participants shall use their best endeavours to amicably settle any dispute arising out of these Terms and Conditions. Failing amicable settlement, a dispute between ESA and a Participant shall be submitted to arbitration according to the Rules of Arbitration of the International Chamber of Commerce and shall be finally settled by one arbitrator or more arbitrators (in this latter case, one appointed by each party and the third one appointed independently). The language of arbitration shall be English. The place of arbitration shall be Paris, France. The Enforcement of the award shall be governed by the rules of procedure in force in France. 

 12.   GENERAL 

(1)    ESA and the Participant are independent parties under these Terms and Conditions and nothing herein is intended nor shall be construed as creating any partnership or similar relationship, whatsoever. 

(2)    The Agency reserves the right to hold void, suspend, cancel, or amend the Awards where it becomes necessary to do so. 

(3)    These Terms and Conditions may be changed by ESA at any time and shall be applicable to the Participant upon notification of change given on the ESA Website.
